Respiratory Program
What happens if an employer does not put a respiratory program in place?
If a Respirator Program is not in place and/or employees have not been medically cleared pursuant to OSHA guidelines the company is subject to the following:
- Corrective Action Plan
- Abatement Certification required within 10 days of Citation and Penalty
- Monetary Penalty of $13,494.00 for first violation; $13,494.00 per day for each day outside of the required abatement period; $134,937 for each repeated violation
- Immediate Posting of Citation and Notification of Penalty where it can be readily observable by all affected employees
- Notice to all Employees of Joint Telephone Conference with OSHA and each employees’ right to attend the Conference to discuss OSHA related issues
- Publication of deficiency and OSHA violation on OSHA government Website
